Pay-to-Delete Agreements — Are They Legal?
Fair Credit Reporting Act · 15 U.S.C. § 1681s-2
✓ VERIFIED
Pay-to-delete is legal but no collector is required to do it. Some collectors will agree to remove an account from your credit report in exchange for payment, but major creditors often refuse. Always get the agreement in writing before paying.
Primary Statute
Fair Credit Reporting Act
15 U.S.C. § 1681s-2
Pay-to-delete arrangements are not prohibited by the FCRA, but they are not legally required. A creditor or collector is not obligated to remove accurate negative information in exchange for payment. Section 623 requires furnishers to report accurately but they can choose to delete accurate negative items voluntarily.
